Chapter 7 bankruptcy was created to help individuals and small businesses erase their debts. This Chapter allows people to get a “fresh start” by erasing credit card debt, medical debt and other unsecured debts. There are some limitations on this “fresh start” which is why it is critical to have a lawyer who is extremely knowledgeable in this Chapter to represent and guide you.

Chapter 13 bankruptcy was created to allow individuals with income to obtain a “fresh start” while keeping property including homes and cars. This Chapter requires you and your lawyer to put together a repayment plan which must be approved by the Chapter 13 Trustee, creditors and the Court.

Chapter 12 bankruptcy is restricted to farmers or others whose business involves growing or harvesting items produced by land. This is the Chapter under which you can apply to the Bankruptcy Court to reorganize your debt and keep your farm.
